The Appellate Court of Maryland has upheld a significant victory for RMG client, the family of Gerald Jones, represented on appeal by Jamar Brown in Harford Memorial Hospital, Inc. v. Josephine Jones, et al.
Mr. Jones died after suffering a pulmonary embolism following surgery at Harford Memorial Hospital (HMH). His family alleged that HMH’s hospitalist, Dr. Robert Kennedy, failed to properly diagnose and treat the condition, leading to his untimely death. After an eight-day trial, the jury found that Dr. Kennedy, as an employee of HMH, was negligent and awarded the plaintiffs more than $1.2 million in damages.
On appeal, HMH challenged the trial court’s evidentiary rulings, claiming they unfairly impacted its defense and created an appearance of bias. The appellate court rejected these arguments, reaffirming Maryland’s strong presumption of judicial impartiality and finding no error in the trial court’s rulings.
